The answer would have been to have a Lasting Power of Attorney in place to protect against such a ‘rainy day’ situation.

However, when faced with a relative with for example dementia and who does not have a LPA, the only solution to resolve the problem is a Court of Protection application to be appointed as a ‘Deputy’

Appointment of a court of protection deputy to handle financial affairs

A detailed Court application is required to secure a Deputy appointment.

The family will need a medical certificate (COP3). At Gregory Abrams Davidson Solicitors with have a network of retained Doctors qualified to attend upon your loved one to assess and prepare the relevant medical report required by the Court.

We will assess the most suitable family member(s) to make the application and will prepare the relevant court application and supporting financial papers. We will prepare the proposed Deputy’s undertakings to the Court and also identify other members of the family and interested parties who will need to be made a party to the application. We will serve all relevant parties with the issued application and all supporting paperwork. Before issue of the Order we will advise upon and assist in obtaining the security bond that need to be set up and provide guidance upon the post order process that will need to be followed once appointed as Deputy.

In the vast majority of cases, the Court application is handled entirely by written communication with the Court and does not require personal attendance.

Subsequent to your appointment we can provide ad hoc assistance in undertaking your duties and in completing annual accounts and reports to the Court.

 We can also advise upon and undertake unique ‘one off’ applications to the Court to deal with any unusual problems that may exist. This may involve the re-placement of a Trustee or the need to obtain consent to a gift, restructuring of assets to achieve a tax saving or to consider the writing of a Statutory Will
